Translated from French. This English version is a translation of the original French text of our conditions générales de vente and is provided for information. In the event of any discrepancy or doubt as to interpretation, the French version prevails (article 16.4).
Version of 23 September 2026. These general terms and conditions replace any previous version.
Article 1 — Identification, scope and definitions
1.1. These general terms and conditions of sale (the “Terms”) apply to all offers, quotes, contracts and services of Polybel Services s.r.l, trade name Ôlift.be, with registered office at Avenue du Roi Albert 167, box 4, 1082 Berchem-Sainte-Agathe (Brussels), registered with the Crossroads Bank for Enterprises under number BE 0798.226.658 (“Ôlift.be”). Contact: 0484 79 11 79 — info@olift.be.
1.2. Ôlift.be offers: (i) the provision of a furniture lift always accompanied by its operator; (ii) the organisation of moves, transport and bulky waste removal, where transport and handling are entrusted to independent partner service providers (article 7).
1.3. The “Customer” is any natural or legal person requesting a service. The “Consumer Customer” is the natural person acting for purposes outside their professional activity. The “Business Customer” is any other person. Where a clause distinguishes between these two categories, only the provision matching the Customer’s status applies.
1.4. Order of precedence: (1) the specific terms of the accepted quote; (2) these Terms; (3) the price list published on www.olift.be. The Customer’s own general terms do not apply unless accepted in writing by Ôlift.be. No clause of these Terms may be interpreted as limiting the rights that the law mandatorily grants to the Consumer Customer.
Article 2 — Quote and formation of the contract
2.1. Every service is preceded by a written quote, free and without obligation, provided on paper or by e-mail (durable medium). The quote states in particular:
- the description of the services (lift with operator, transport, handling, etc.), and the addresses and floors concerned;
- the total price, excluding VAT and including all taxes (VAT 21%), or its calculation method where the price depends on the duration;
- the date or period of performance, the planned time and the estimated duration;
- the amount of any deposit, and the payment terms and methods;
- the insurance and liability terms in case of breakage or loss, and how complaints are handled;
- the information that the Consumer Customer has no right of withdrawal (article 12);
- the validity period of the offer (in principle 15 or 30 days).
2.2. The contract is only formed once the Customer has accepted the quote in writing: signature preceded by the words “Approved” (“Bon pour accord”) or confirmation by e-mail. A verbal agreement, in particular by telephone, does not bind the Customer: any request made by telephone is always confirmed by a written quote, and the Customer is only bound once they have accepted it in writing.
2.3. The start of the service is subject to the written acceptance of the quote and, where applicable, payment of the agreed deposit.
2.4. The quote is based on the information provided by the Customer (volume, weight, floors, access, layout of the premises). If the situation found on site differs significantly from that information, Ôlift.be informs the Customer before any additional service, which will only be carried out with their agreement; failing agreement, Ôlift.be may limit its work to what was agreed.
Article 3 — Prices
3.1. Prices are expressed in euros. They are shown excluding VAT together with the amount including all taxes (VAT 21%), which is the total price payable by the Consumer Customer.
3.2. The lift service is charged per one-hour block (60 minutes), operator and insurance included, according to the price list in force on the date of the quote. Any time beyond the booked duration is charged at the rate stated in the quote or, failing that, €40 excl. VAT, i.e. €48.40 incl. VAT, per 30-minute block started.
3.3. The price only covers the services mentioned in the quote. Additional costs (travel outside Brussels, waiting time, difficult access, parking space, etc.) may only be charged if they appear in the quote or have been accepted in writing by the Customer.
3.4. VAT and other statutory taxes are payable by the Customer. If the VAT rate is changed by law before invoicing, the amount still to be invoiced is adjusted accordingly.
Article 4 — Payment
4.1. Payment methods: bank transfer (electronic payment) to account IBAN BE32 0019 4790 5702 — BIC GEBABEBB in the name of Polybel Services s.r.l, or cash payment. Cash payments are accepted up to the legal ceiling of €3,000; above that, the balance is paid by bank transfer.
4.2. A deposit may be requested at booking; its amount is stated in the quote. Unless otherwise stated in the quote or invoice, the balance is payable in full at the end of the service. For long-term or recurring services, Ôlift.be may, if the quote so provides, issue interim invoices according to progress.
4.3. Late payment — Consumer Customer: in case of non-payment on the due date, Ôlift.be sends a first reminder free of charge and grants a payment period of at least 14 calendar days. Failing payment within that period, and in accordance with articles XIX.2 et seq. of the Belgian Code of Economic Law, the outstanding amount is increased by late-payment interest at the statutory interest rate plus 8 percentage points and by a fixed compensation of €20 if the outstanding balance is €150 or less; €30 plus 10% of the amount due on the portion between €150.01 and €500; €65 plus 5% of the amount due on the portion above €500, up to a maximum of €2,000.
4.4. Late payment — Business Customer: any amount unpaid on the due date bears, automatically and without formal notice, interest at the rate set by the Belgian law of 2 August 2002 on combating late payment in commercial transactions, and gives rise to a fixed compensation of 8% of the unpaid amount, with a minimum of €75, without prejudice to legal costs. Any overdue and unpaid debt makes the Business Customer’s other debts to Ôlift.be immediately payable.
Article 5 — Performance of the services
5.1. The lift service is available every day of the year, from 07:30 to 21:30; jobs on Sundays and public holidays are priced on quote. The lift serves the 1st to the 9th floor, subject to technical feasibility (layout of the façade and the street), checked when the quote is prepared.
5.2. The lift is set up, operated and monitored exclusively by Ôlift.be’s operator. The Customer and the persons for whom they are responsible must not operate it and must follow the safety instructions given by the operator (maximum load, placement of goods, safety perimeter).
5.3. Customer’s obligations: ensure practicable access to the place of work; check that windows, balconies or terraces allow the goods to pass; prepare the goods (dismantling, packing) unless otherwise agreed; provide all useful information, in particular on the weight or fragility of the goods; be present or represented throughout the job. Dangerous or flammable substances may not be carried on the lift platform.
5.4. Municipal permits: the Customer is responsible for obtaining, in good time, the permits required for the job (parking, use of the public road, space reservation, signs), unless the quote exceptionally provides that Ôlift.be will handle them. If the job cannot take place or is delayed due to the absence or irregularity of these permits, the resulting costs (waiting time, wasted trip, postponement) may be charged to the Customer, insofar as they are justified and, for the Consumer Customer, reasonable.
5.5. Weather conditions and safety: the operator may interrupt, suspend or postpone the job when weather conditions (strong wind, storm, black ice…), the condition of the premises or any other circumstance endanger the safety of people, goods, equipment or traffic. The job is then postponed to a date agreed with the Customer; only the time actually worked is charged and no compensation is due by either party.
Article 6 — Equipment
6.1. The lift, its accessories and all equipment used for the service remain the exclusive property of Ôlift.be. The Customer acquires no rights over this equipment.
6.2. The Customer is liable for damage to the equipment resulting from their fault or that of the persons for whom they are responsible (unauthorised operation, overloading, incorrect declaration of the weight of goods, failure to follow safety instructions). Repair costs are then charged to them on the basis of supporting documents.
Article 7 — Partner service providers
7.1. Transport, handling and bulky waste removal are carried out by independent partner service providers holding the permits required for their activity, selected and coordinated by Ôlift.be. Their involvement is stated in the quote.
7.2. Ôlift.be remains the Customer’s point of contact for the whole service described in the quote and assists them with any steps in case of damage occurring during a partner’s work (article 9).
Article 8 — Insurance
8.1. Ôlift.be’s professional liability is covered by a policy taken out with AG Insurance, for services carried out with its lift, including damage to goods entrusted, within the limits and conditions of that policy (“goods entrusted” cover: €25,000 per claim).
8.2. Damage occurring during transport or handling carried out by a partner is covered by that partner’s own insurance.
8.3. Customers entrusting high-value items (works of art, valuables, instruments…) are asked to report this before the job; additional insurance may be recommended.
Article 9 — Liability
9.1. Ôlift.be performs its services with the care of a diligent professional. It is not liable for damage resulting from force majeure, inaccurate or incomplete information provided by the Customer, failure to follow safety instructions or the actions of persons for whom the Customer is responsible.
9.2. Damage to third-party property (building, common areas, neighbours) caused by a fault, negligence or instruction of the Customer or of persons for whom they are responsible remains the Customer’s responsibility.
9.3. Consumer Customer: Ôlift.be’s liability is governed by ordinary law. No provision of these Terms exempts it from liability in the event of fraud, gross negligence or failure to perform an essential obligation of the service.
9.4. Business Customer: Ôlift.be is bound only by an obligation of means. Except in case of fraud, gross negligence or failure to perform an essential obligation, its liability per claim is limited to the amount paid by its professional liability insurer; it is never liable for indirect damage (operating loss, loss of profit, schedule disruption, loss of customers, etc.).
9.5. Force majeure: neither party is liable for failure to perform its obligations caused by an event beyond its control that it could not reasonably foresee or avoid. The party concerned informs the other without delay; the service is postponed to an agreed date or, if postponement is impossible, the contract ends without compensation and any sums paid for services not performed are refunded.
Article 10 — Complaints and damage
10.1. Any damage found must be reported in writing (e-mail to info@olift.be), with photos if possible, within 72 hours of the job, so that it can be recorded and promptly declared to the relevant insurer. For the Consumer Customer, this period is a recommendation intended to make handling the claim easier and does not deprive them of any legal right.
10.2. Any other complaint (service, invoice) must be sent in writing to info@olift.be. Ôlift.be acknowledges receipt and responds within 15 days.
10.3. Business Customer: complaints about a visible defect must be made within 8 days of the service, and complaints about an invoice within 14 days of it being sent; otherwise the service or invoice is deemed accepted. Any legal action must be brought within 6 months of the complaint.
10.4. Mediation: failing an amicable solution, the Consumer Customer may contact the Consumer Mediation Service free of charge, North Gate II, Boulevard du Roi Albert II 8, box 1, 1000 Brussels — mediationconsommateur.be.
Article 11 — Cancellation and termination
11.1. Cancellation by the Customer: the Customer may cancel their booking in writing. Any deposit paid is then retained by Ôlift.be as fixed compensation, regardless of the notice given. If no deposit was paid, a fixed compensation of 10% of the price of the cancelled services is due. No other amount is due for services not performed.
11.2. Cancellation by Ôlift.be (other than a postponement for safety reasons under article 5.5 and other than force majeure): Ôlift.be refunds the deposit in full and pays the Customer compensation equal to that which the Customer would have owed under article 11.1.
11.3. Business Customer: Ôlift.be may terminate the contract with immediate effect in the event of a serious breach by the Customer of its obligations, in particular payment, or in the event of the Customer’s bankruptcy, judicial reorganisation or dissolution; such termination is treated as a cancellation by the Customer.
Article 12 — No right of withdrawal
In accordance with article VI.53, 12° of the Belgian Code of Economic Law, the Consumer Customer does not have the 14-day right of withdrawal for goods transport services — provision of a lift with operator, moving, transport and bulky waste removal — where the contract provides for a specific date or period of performance. This information also appears in every quote. However, the Customer is only bound once they have accepted the quote in writing (article 2.2).
Article 13 — Suspension for non-performance
If the Customer fails to meet their obligations (in particular payment of the deposit or of an overdue invoice), Ôlift.be may, after informing them in writing, suspend performance of its own obligations until the situation is remedied. Conversely, the Consumer Customer may suspend payments if Ôlift.be fails to perform its obligations.
Article 14 — Personal data
The Customer’s personal data is processed in accordance with the General Data Protection Regulation (GDPR), solely for preparing the quote, performing the contract and complying with legal obligations, as described in our privacy policy.
Article 15 — Severability
The invalidity or unenforceability of any clause does not affect the validity of the other clauses. For the Business Customer, the clause concerned is reduced to what is legally permissible, in line with the parties’ original intention.
Article 16 — Governing law and jurisdiction
16.1. Relations between Ôlift.be and the Customer are governed exclusively by Belgian law.
16.2. Business Customer: any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Ôlift.be’s registered office (Brussels). The language of proceedings is French.
16.3. Consumer Customer: the dispute is brought before the competent court in accordance with the Belgian Judicial Code, in particular the court of their place of residence.
16.4. In the event of any discrepancy between the language versions of these Terms, the French version prevails.
